29 CFR OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crush by hazard: At a residential worksite located at 15905 Richmond Ave, Belton MO -- The employer is failing to protect employees from crush by hazards. An employee performing tree removal operations using a Bobcat MT52 Mini Track Loader, PIN 523611280 with fork attachment, was operating on a slope with forks raised overhead and over the maximum weight capacity when the MT52 tipped forward crushing the victim. Instances of failure include, but not limited to: a. Operator driving MT52 with the forks raised while driving downhill. b. Operator driving MT52 over the maximum weight capacity of 520 pounds.
