OSH ACT of 1970 Section (5)(a)(1):The employer is failing to furnish a place of employment that is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck-by and caught-in-between hazards. The employer is failing to prevent employee exposure to struck-by and caught-in between hazards. On or about July 29, 2021 at 1616 Woodson Road, Overland, Missouri, employees work in the fall shadow of stone slab bundles that weigh approximately 4,902-6,536 pounds during the shipping container unloading process. Employees enter the fall shadow to remove wooden shipping bracing that previously stabilized each bundle in an upright and secure position. The bracing removal process destabilizes the load creating a struck-by or caught-in-between hazard when employees are in the fall shadow. An employee suffered a fatal injury when struck and caught in between destabilized bundles of stone slabs during the unloading process.
