OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were exposed to excessive heat: a) Foundry Area, on or about June 28, 2021: An employee performing heavy work shoveling sand in the shake out area for approximately 8.5 hours and was exposed to the hazard of high ambient heat from various sources, including outdoor conditions, heated foundry sand and molten metal. On June 28, 2021, meteorological conditions in Solvay, NY yielded WGBT calculated values ranging from 23.38 to 28.72 degrees Celsius during the 8.5 hours work shift. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. The employee collapsed in the work area and was hospitalized with a core body temperature of 41.11 degrees Celsius. The employee was not acclimatized to working in hot conditions, as June 28 was the employee's first day on the job.
