29 CFR 1910.269(a)(2)(viii): The employer did not ensure that each employee has demonstrated proficiency in the work practices involved before that employee was considered as having completed the training required by paragraph (a)(2) of this section: IN THE ALTERNATIVE Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to delays of potentially life-saving cardiopulmonary resuscitation (CPR) when working in buckets at height. a) Congress and Mirabeaux job site: On or about June 23, 2021, employees worked to move live 23 kV phase lines from a rotten wooden arm without being able to demonstrate proficiency with safety-related work practices including, but not limited to, bucket rescue.
