OSH ACT of 1970 Section (5)(a)(1) Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Between 229 and 235 South Market Street Frederica, DE 19946: On or about June 29, 2021, the employer failed to fully implement controls related to fire protection programs and struck-by hazards related to traffic and heavy equipment which resulted in exposure to hazards that were likely to cause death or serious physical harm which were recognized.
