29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment to control or eliminate any hazards or other exposure to illness or injury. a) At the vicinity of 6820 Cold Brook Road, Scott, NY ., on or about June 1, 2021 and thereafter: The employer did not train workers to recognize and avoid dangers related when working at or near water. Workers were required to swim across a pond, resulting in the drowning of a worker. b) At the vicinity of 6820 Cold Brook Road, Scott, NY ., on or about June 1, 2021 and thereafter: The employer did not train workers to recognize and avoid electrical hazards when installing fiber optic lines on pre-existing electrical poles . Work was performed within 5 feet of 4.8 KV overhead electrical lines without any protective controls in place.
