29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Dunaway Excavating, Inc. at 4387 Lacewood Lane, Johnstown, CO 80534: On April 16, 2021, and at times prior, the employer did not ensure that each employee on the jobsite was trained on safety and health hazards in trenching operations. Two employees excavated a trench approximately 16 feet deep that had accumulated water at a depth of at least two feet to install a sewer tie-in. The trench was not properly sloped or benched and no other protective systems were in place. At least one of the employees was not instructed in the recognition of and avoidance of unsafe conditions or hazards or the regulations applicable to trenching and excavation, including but not limited to water accumulation, trench wall fissures, sloughing of soil, cave-ins, and spoil pile hazards. This condition exposed employees to cave-in and struck-by hazards.
