29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by or caught-in between operating motor vehicles and equipment: a) Paving job for DELDOT - Work zone at Warrington Road Between Route 24 & Old Landing Road, in Rehoboth Beach, DE 19971, on both sides of the road as well as flagging at the three way (road closed) intersection: On or about 4/2/2021, Employees were exposed to multiple hazards onsite including but not limited to struck by/ caught in-between hazards when they performed flagging operations and other operations to facilitate site preparation work for widening/ future paving without the use of a properly communicated traffic control plan and internal traffic control plan. One feasible and acceptable means of abatement would be to follow The American National Standards Institute (ANSI)/ American Society of Safety Engineers (ASSE) A10.47- 2015, Work Zone Safety for Highway Construction, American National Standard for Construction and Demolition Operations requires the use of a traffic control plan and internal traffic control plan. The employer should follow requirements in sections 6.1-6.5.2 to establish proper plans in advance of placing employees on site.
