29 CFR 1910.22(c):29 CFR 1910.22(c): The employer did not provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces. (a) South Dock - The employer did not ensure that a safe means of access was provided for employees to travel to and from walking working surfaces in the dock area including when accessing the control panel for the dock doors. On March 26, 2021, an employee walking on the dock-leveling platform device, attempting to access the controls for Dock Door 7, sustained fatal crushing injuries when a stack of uneven/unstable load fell on the employee. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.
