Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees Section 5(a)(1) of the OSH Act. Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. Worksite, Mineola Train Station: On or about March 13, 2021, employees were exposed to a hazard that created the potential for death or serious physical harm while performing work and operating equipment near energized overhead power lines that the employees thought were de-energized. The employer failed to implement sufficient management oversight of the scope of work being performed. Feasible means of abatement include: (1) requiring superintendents to receive written confirmation of power outages prior to allowing work in their zone to commence; (2) improving job site management and accountability including ongoing audits, improved training and overhead hazard checklists.
