29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment that were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to ejection and crushing hazards while operating rough terrain powered industrial truck without wearing a seatbelt: On or about January 21, 2021, and at times prior, employees were exposed to ejection and crushing hazards while operating the Lull model 644B-37 rough terrain forklift which was equipped with an unused/inoperative seatbelt.
