29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Pre-Fabrication Shop: On or about 2/11/2021 and at times prior; the employer exposed employees to struck-by hazards, in that the employer allowed an employee to operate the Nissan powered industrial truck (forklift) Model MYG1F2A30V Serial Number YG1F2-9M0753 without a seatbelt installed, when transporting product from one side of the pre-fabrication shop to the other.
