29 CFR 1910.147(c)(2)(ii): If an energy isolating device is capable of being locked out, the employer's energy control program under paragraph (c)(1) of this section shall utilize lockout, unless the employer can demonstrate that the utilization of a tagout system will provide full employee protection as set forth in paragraph (c)(3) of this section: a) On or about December 8, 2020, the employer failed to ensure that the Borghi (B6-210-96) brush machine was locked out prior to employees performing tasks such as but not limited to drill bit change outs and machine set ups. Employees are exposed to hazards such as but not limited to being struck by or caught in between various parts of the machine due to stored energy being released (electrical, pneumatic and mechanical). An employee sustained a partial fingertip amputation on this machine due to mechanical stored energy. b) On or about December 16, 2020, the employer failed to ensure that the Borghi (B4A-201-94) brush machine was locked out prior to employees performing tasks such as but not limited to drill bit change outs and machine set ups. Employees are exposed to hazards such as but not limited to being struck by or caught in between various parts of the machine due to stored energy being released (electrical, pneumatic and mechanical). c) On or about December 16, 2020, the employer failed to ensure that the Borghi (B4B-3847) brush machine was locked out prior to employees performing tasks such as but not limited to drill bit change outs and machine set ups. Employees are exposed to hazards such as but not limited to being struck by or caught in between various parts of the machine due to stored energy being released (electrical, pneumatic and mechanical). d) On or about December 16, 2020, the employer failed to ensure that the Borghi (B4C-376-1993) brush machine was locked out prior to employees performing tasks such as but not limited to drill bit change outs and machine set ups. Employees are exposed to hazards such as but not limited to being struck by or caught in between various parts of the machine due to stored energy being released (electrical, pneumatic and mechanical). e) On or about December 16, 2020, the employer failed to ensure that the Borghi (B4D-208-95) brush machine was locked out prior to employees performing tasks such as but not limited to drill bit change outs and machine set ups. Employees are exposed to hazards such as but not limited to being struck by or caught in between various parts of the machine due to stored energy being released (electrical, pneumatic and mechanical).
