29 CFR 1926.102(a)(1): The employer does not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a. Employees performing roofing work are not protected from eye injuries while using pneumatic nail guns. The employer fails to assure effective protections against eye and face injuries as required by the standard, as demonstrated on December 9, 2020, when employees are working on a residential roof at Lot 178, Gainesville, Florida, without eye protection while using pneumatic nail guns and are exposed to eye injuries from flying debris or nails.
