29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed by hazards. At the facility, 452 West 43rd Street New York, NY- Basement Area. On or about 12/15/20 a) An employee was loading merchandise onto a dumbwaiter/elevator lift that did not have a functioning interlock for its doors. The dumbwaiter/elevator lift platform started to ascend with the doors opened and the employee was caught in between the platform and the doorframe. Among other methods, several feasible and acceptable abatement methods to correct the hazards include: Compliance with ASME A17.1-2019?CSA B44:19, Safety Code For Elevators (Includes Requirements for Elevators, Escalators, Dumbwaiters, Moving Walks, Material Lifts and Dumbwaiters with Automatic Transfer Devices. a) Section 2.14.4.11 (page 66) requires that car doors are provided with a car door interlock to prevent movement. Closed Position of Car Doors or Gates Horizontally sliding doors, vertically sliding counterweighted doors and horizontally sliding center-opening doors are to be provided with car doors interlock(s). b) Section 8.6.1.2.1 (page 346) requires A written Maintenance Control Program (MCP) shall be in place to maintain the equipment in compliance with the requirements of section 8.6. c) Section 8.6.1.3 (page 347) Maintenance Personnel: Maintenance, repairs, replacements and test shall be performed only by elevator personnel.
