29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of falls when walking/working on top of rolling stock: On or about December 8, 2020, at the Texas Port Recycling facility, fall protection was not provided when working from the top of a trailer of an 18-wheeler at an approximate height of 11 feet from ground level. Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: 1. Provide drivers with, and require the use of, conventional fall protection systems when climbing on the trailer. 2. Implement work practices such as site-specific instructions for handling malfunctioning tarping systems and safe climbing techniques (e.g., 3-point climbing).
