29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): Janiec Roofing, Inc, and Chet Janiec does not ensure that employees use appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about 12/09/2020, at 335 Oradell Ave, Paramus NJ , at instance (a): Exterior Framing- where employees were engaged in in roofing activities on a 4 on 12 pitched roof in which a means of fall protection had not been utilized exposing employees to fall hazards of approximately 18ft to the asphalt driveway and lawn area below. To abate this violation the employer must ensure that its employees performing roofing work are protected from falls and that no employee is allowed to be exposed to a fall hazard of 6 foot or more without adequate fall protection.
