29 CFR 1910.134(a)(2): A respirator was not provided to each employee when such equipment was necessary to protect the health of such employee: 452 Individualized Residential Alternative (452 IRA) Operated by Maryhaven Center of Hope Inc. 452 Miller Place Road, Miller Place, NY 11764 a. On or about November 19, 2020, employees providing direct personal care to COVID-19 positive residents were provided only with surgical mask for protection against aerosolized SARS-CoV-2 virus. At a minimum, a N95 NIOSH-certified filtering facepiece respirator is necessary to protect employees from aerosolized SARS-CoV-2 virus. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
