29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. (a) Interstate 395 - On or about October 23, 2020, a construction worker removing traffic control barrels along a highway work zone was struck by a truck and hospitalized. The incident was not reported by the employer to OSHA until October 27, 2020. The Fort Myer Construction Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.39(a)(2), which was contained in OSHA inspection number 1244615, citation number 1, item number 1 and was affirmed as a final order on 12/15/2017, with respect to a workplace located at 1308 Clifton St., NW, Washington, DC 20005.
