Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about 10/21/2020 and 11/10/2020, at the job site - employees were exposed to fall hazards, in that, the employer permitted the operation of scissor lifts in which the guardrails were not set at 42 +/- 3 inches. The top rear side guardrail of a JLG 2030ES scissor lift was set at 50 inches and the intermediate guardrail was at 28 inches. Additionally, multiple scissor lifts were lower in the front, in that, guardrails were removed and replaced with chains and in once instance the top chain was set at 30 inches and the intermediate guardrail was at 11 inches. b. On or about 10/21/2020, at the job site - employees were exposed to fall hazards, in that, the employer permitted the installation of flexible materials, such as chains, as a replacement for the top rails of the scissor lift guardrails. Chains are only permitted to access the platform and only may be used as a mid-rail at access openings 30 inches wide, or less. c. On or about 11/10/2020, at the job site - employees were exposed to fall hazards, in that, the employer permitted the use of SkyJack SJIII 4626 scissor lift, equipment # PL51W, with structural damage to the base of the vertical upright of the top guardrail in the front section. d. On or about 11/10/2020, at the job site - the employer conducted modifications to scissor lifts, such as welding chains and square tubes to the scissor lifts without the authorization of the manufacturer or a certification by an engineer.
