29 CFR 1910.178(l)(4)(ii)(B): Refresher training and evaluation was not provided to the operator when the operator was involved in an accident or near-miss incident. a) Railyard - On or about September 24, 2020, an operator was involved in an accident when he ran over an employee with a Konecranes Reach Stacker, SMV 4543 TCX5, Serial Number M10620. The operator used the powered industrial vehicle on November 19, 2020, to load and unload containers and had not received refresher training.
