OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment, which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about September 14, 2020, and at times prior thereto, storage racks, in various locations throughout the facility, were visibly damaged exposing employees to struck-by hazards. a) Storage rack in cooler (location row 40 H) had damaged structural sections and legs; b) Storage rack at dock doors 90-92 outside cooler and freezer area (location below H39 26 H1) had structural damage missing anchor bolts to secure the racking systems; c) Storage rack (location M39 J1-M1) did not have marked weight capacities and was structurally damaged; and d) Storage rack (location M 41 57 L2-L-3) had structural damage.
