29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a. On or about August 27, 2020, at the jobsite, around 9:55 am, three untrained employees were directed to work in a trench 6 feet 3 inches deep, with type C soil, and without cave-in protection. b. On or about August 27, 2020, at the same jobsite as above, around 12:45 pm, the same three untrained employees were directed to work in the same trench, without adequate cave-in protection.
