OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazards of being struck-by fragments of Thermoplastic Polyvinyl Chloride (PVC) plastic pipe in the event of rupture. a) On or about August 25, 2020 and at times prior, at the fabrication shop, PVC plastic piping was used exposed above ground to transport compressed air at 115, 140 and 150 psi for the operation of pneumatic machines and tools, exposing employees to struck-by hazard.
