29 CFR 1926.65(b)(1)(i): The employer did not develop and/or implement a written safety and health program that was designed to identify, evaluate, and control safety and health hazards, and provide for emergency response for hazardous waste operations: a) North End Seawall: On or about July 15, 2020, employees performed clean-up operations excavating and placing contaminated soil containing hazardous material into containment without a written safety and health program for hazardous waste operations, and were exposed to chemicals such as, but not limited to volatile organic compounds.
