OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each employee employment and a place of employment which was free from the recognized hazard that was causing or likely to cause death or serious physical harm to employees in that employees were exposed to excessive heat conditions while performing refuse collection tasks. The employer is failing to protect employees from the hazard of excessive environmental heat. On July 7, 2020, employees worked outside when ambient air temperatures ranged from 79-93 degrees Fahrenheit, with 44-79% relative humidity, and a calculated web bulb temperature of 75-94 degrees Fahrenheit. The excessive heat level exposed acclimatized and unacclimatized employees to heat-related illnesses such as heat exhaustion. On or about July 7, 2020, an employee suffered from fatal heat-related illness as a result of prorogued physical activity in hot conditions.
