Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while working in a roadway: On or about June 24, 2020, an employee was exposed to a struck-by hazard while directing traffic in a public roadway during window washing operation that required the setup and use of a temporary traffic control zone. The employee was not using a Stop/Slow paddle to direct traffic motorists nor were there any advance warning signs in place to inform motorists that a flagger station and a lane closure was ahead. Among other methods, feasible and acceptable means of abatement include following the Manual on Uniform Traffic Control Devices (MUTCD) 2009 Edition, Chapter 6E.07.02 Flagger Procedures and Chapter 6E.08.04 Flagger Stations. Flaggers shall use a Stop/Slow paddle, a flag, or an Automated Flagger Assistance Device (AFAD) to control road users approaching a temporary traffic control zone. The use of hand movements alone without a paddle, flag, or AFAD to control road users shall be prohibited except for law enforcement personnel or emergency responders at incident scenes as described in Section 6I.01. Except in emergency situations, flagger stations shall be proceeded by an advance warning sign or signs. Except in an emergency situations, flagger stations shall be illuminated at night. American National Skyline, Inc. was previously cited for a violation of this occupational safety and health standard, OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 1181183, citation number 1, item number 1 and was affirmed as a final order on 02/14/2017, with respect to a workplace located at 611 W. Park St. Carle Hospital Skywalk Urbana, IL 61801.
