29 CFR 1926.502(b)(13):When guardrail systems were used around holes which were used as access (such as ladderways), they were not provided with a gate, or were not so offset that a person could not walk directly into the hole: (a) Baker Concrete Construction, Inc., at 6450 York Street, Denver, CO: On 6/17/2020, Baker Concrete Construction, Inc. did not ensure that when guardrail systems were used around holes which were used as access (such as ladderways), they were provided with a gate, or were so offset that a person could not walk directly into the hole. Employees used a wood job-built ladder to access the fourth level within the BDSF building. The ladder used as its upper point of access a floor hole in the fourth level. The guardrail system used around the floor hole had a gap of twenty-two inches on the left side of the ladder and a gap of thirty-six inches on the right side of the ladder. Each gap led directly to the floor hole. The guardrail system used around the floor hole was not provided with a gate nor was it offset. This condition exposed employees to an approximate 14.5 foot fall hazard.
