Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: industrial storage rack collapse and struck by hazards: On or about 6/17/2020 in areas including but not limited to Freezer room 2, workers on foot and or operating powered industrial equipment were exposed to struck by and crushing hazards where the loaded industrial storage racks were visibly damaged by powered industrial trucks at locations including but not limited to: a. Aisle 8, Rack 14 damaged upright, under load b. Aisle 8, Rack 14 damaged upright, under load c. Aisle 8, Rack 14 damaged stretcher, under load d. Aisle 2, Bay 2 damaged upright, under load e. Aisle 2, Bay 2 damaged stretcher, under load f. Aisle 3, Bay 2 damaged upright with in-house welded plate, under load g. Aisle 3, Bay 2 damaged upright, under load h. Aisle 3, Bay 2 damaged upright, under load i. Aisle 3, Bay 2 damaged upright, under load j. Aisle 3, Bay 2 damaged upright, under load k. Aisle 3, Bay 2 sheered/missing stretcher, under load l. Aisle 3, Bay 2 sheered/missing stretcher, under load m. Aisle 3, Bay 2 upright twisted, under load n. Aisle 3, Bay 4 stretcher weld broken, under load o. Aisle 3, Bay 4 stretcher weld broken, under load One feasible means of abatement would be to maintain the structural integrity of the installed rack system by assuring proper operational, housekeeping, and maintenance procedures including but not limited to: Regularly inspect for damage. If damage is found, IMMEDIATELY unload the affected area and replace or repair any damaged columns, beams, or other structural components."
