OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) 2075 Baltimore Pike, Oxford, PA, 19363- Growing Room #3, second level: On or about 6/5/2020, employees performed tasks associated with mushroom growing activities such as but not limited to irrigation from an elevated movable walking/working surface which was left in the raised position, creating a hole which allowed employees to fall to a lower surface approximately 76 inches below, resulting in an employee injury. Abatement Note: An acceptable means of abatement would be to fully plank the walking/working surfaces and/or ensure that a fall protection system (guard rails, covers, nets or personal fall arrest system) be in place for employees working from elevated walking/working surfaces.
