29 CFR 1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a. On or about May 26, 2020, for the County Road 25, Marengo, Ohio worksite; the employer failed to provide for frequent and regular inspections of the worksite by a designated competent person. A competent person was not assigned to this worksite to perform inspection of the job site for hazards, unsafe behavior and to prevent accident occurrence. On this date, an employee suffered fatal injuries when his head was crushed against a tree by the Caterpillar Model 305E2 mini excavator that he was operating.
