29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident. a) At the facility, 4295 Hempstead Turnpike, Bethpage, New York, 11714: On or about May 12, 2020, the employer did not notify OSHA within eight hours of a work-related COVID-19 fatality of a Nursing Assistant who provided direct care to confirmed positive COVID-19 patients in the progressive care unit (PCU). The employee died on May 11, 2020 and the employer was notified of the fatality on May 12, 2020 but not report the fatality to OSHA within 8 hours.
