OSH ACT of 1970 Section (5)(a)(1): The employer is failing to furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards, while operating and troubleshooting Bobcat skid steers. Butte Implement Company: 530 Carl St, Butte, Nebraska 68722 - On May 7, 2020, an employee received fatal head injuries while attempting to troubleshoot repairs made to a Bobcat Skid Steer. The skid steer was operating but the employee was not in the drivers seat at the time of the incident. Among other methods, feasible and acceptable methods to correct this hazard includes, but are not limited to the following: i) Provide operator training to employees to address the hazards associated with operating skid steers per NIOSH Publication 98-117. ii) Develop procedures for protecting employees working on or near skid steers during troubleshooting operations when complete lockout and de-energization is not possible, per maintenance manual warnings. iii) Develop procedures to identify hazards like bypassed or inoperative safety systems to mitigate these hazards prior to employee exposure as per OSHAs Safety and Health Bulletin 01-12-2009. Examples include inoperative brakes, and bypassed seat safety switches.
