29 CFR 1910.134(a)(2): A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee: a) Virtua Voorhees Hospital Homecare: On or about April 27, 2020, to May 26, 2020, the employer did not provide N95 respirators to nurses providing home care to patients who displayed COVID-19 symptoms and/or were known to be COVID-19 positive. Nurses were only required to wear surgical masks when exposed to patients who displayed COVID-19 symptoms and/or were known to be COVID-19 positive. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
