OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about February 6, 2020, and at times prior thereto, on the west side of the battery room employees operated a crane with an unrated, and uncertified spreader bar exposing the employees to being struck-by the load. The employer, Penske Logistics was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 1418637, citation number 1, item number 1 and was affirmed as a final order on 10-4-2019, with an abatement date of 10-10-19, with respect to a workplace located at 5801 Kroger Drive, Keller, Texas.
