29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) True North Urgent Care, LLC dba Northwell Health-GoHealth Urgent Care Eltingville, 4316 Amboy Rd, Staten Island, NY: On or about 5/09/2020 and continuing thereafter, employees such as, but not limited to radiological technicians and medical assistants were required to wear N95 respirators when providing medical and radiology services to suspected or confirmed COVID-19 positive patients. Employees who were required to wear N95 respirators were not provided a medical evaluation to ensure they were medically able to wear the respirators.
