29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. At the worksite located at 13000 East 35th St. S., Independence, MO 64055, the employer is failing to record a work-related fatality and work-related illness on the OSHA Form 300 or equivalent for the calendar year 2020. Employees experienced illness due to COVID-19. All instances of failure to record were confirmed by OSHA on May 5, 2020, via the employer's production of the OSHA Form 300 or equivalent for calendar year 2020. a) On April 10, 2020, the employer reported to USDOL-OSHA an employee death related to COVID-19 that occurred on April 9, 2020. The employer failed to record the fatality. b) An employee who worked in the warehouse department was hospitalized and tested positive for COVID-19. This employee had been off work and in quarantine since March 29, 2020, per the employer's instructions. He was hospitalized on or about April 9, 2020, and remained off work until June 4, 2020. The employer became aware the employee was hospitalized on April 9, 2020, and was aware the employee had been exposed to a COVID positive coworker on March 28, 2020. The employer failed to record the days away from work. c) An employee who worked in the warehouse department was hospitalized and tested positive for COVID-19. The employee had been off work since April 3, 2020, when he was sent to urgent care by the employer. He was hospitalized on or about April 9, 2020, and he remained off work for his illness until April 24, 2020. The employer became aware the employee was hospitalized and had tested positive for COVID-19 on April 9, 2020, and was aware the employee had been exposed to a COVID positive coworker on March 28, 2020. The employer failed to record the days away from work.
