Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: The employer is failing to protect employees from struck-by and crushing hazards. This was most recently documented on or about April 9, 2020, at the Northeast corner of 160th road and 130th Avenue in Harper, KS. The employer allowed two employees to change flashing on the top of the powered and energized Wolfe Man 8000 trencher. As the trencher operator exited the equipment, he moved a control, activating the conveyor and trenching wheel, causing the helper to fall into the crumbing shoe and the machine wheel, crushing the employee. Among other methods, feasible and acceptable means to correct this hazard includes but is not limited to the following: 1)Developing and implementing measures to effectively monitor operators and helpers to utilize the Wolfe Man 8000 trencher, by following: a) American Pipeline Contractors Association (APCA) Excavation & Trenching, Toolbox Talks: Caught In/Between Toolbox Talk #2, Safely Performing Maintenance on Site Equipment. b) Follow manufacturer's procedures for operating, maintaining, and cleaning of the Wolfe Man 8000. c) Before servicing this machine put a Do Not Operate tag on the start key switch or machine controls. d) Before servicing or repairing this machine, make sure that all machine components or auxiliary equipment are in the down or safe position. Support the components or auxiliary equipment properly before performing any work or maintenance beneath the machine.
