Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when riding inside a cattle trailer while transporting calves: The employer is failing to protect employees from potential struck-by, caught between, crushing and fall hazards associated with the improper use of livestock trailers. This was most recently evident on March 16, 2020 at the company facility located at 3272 B Rd. Rising City, NE 68658 where the employer has Employees unloading calves from a semi-trailer and transferring them to a smaller cattle trailer. Employees then rode inside trailer with the calves while transporting them to their housing units. Instances of exposure include but not limited to: March 16, 2020 Where an employee of the company was riding in the trailer with the calves when the trailer door came open during travel causing one of the employees to fall out and hit his head on the concrete. The employee suffered severe head trauma that resulted in three brain bleeds.
