29 CFR 1926.150(a)(4): All fire fighting equipment was not periodically inspected and maintained in operating condition: a) On or about 03/06/20, at the Commissary Downtown Kitchen Incubator in Sibley Square located on 250 East Main Street, in Rochester, New York, the employer did not remove from service a fire extinguisher that had been discharged and no longer operable. Flammables such as aerosol paints were stored in the immediate area and ignition sources (electrical tools and equipment) were in use. NO ABATEMENT CERTIFICATION REQUIRED
