OSH ACT of 1970 Section (5)(a)(1): : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to ejection and crushing hazards: a) Lot 15 Colonial Lane Rehoboth, DE - On or about March 5, 2020, an employee sustained fatal crushing injuries when he was ejected from and pinned beneath a Case Uni-Loader Skid Steer - Model 1840, on which the Control Interlock Device was bypassed. Among other methods, a feasible and acceptable method of abatement to correct these hazards is to ensure safety devices, including seatbelts and Control Interlock Devices are both functioning and utilized by operators, as outlined in the Association of Equipment Manufacturers (AEM) Skid Steer Loader Safety Manual and the National Institute of Occupational Safety and Health (NIOSH) Alert - Preventing Injuries and Deaths from Skid-Steer Loaders.
