Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer is failing furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer is failing to protect employees from struck-by hazards associated with the operation of a PITS. This was most recently documented on or about February 20, 2020 in the truck maintenance garage of the Hiland Dairy plant located at 2901 Cuming Street, Omaha, NE 68131 An employee operated the Towmotor PITS which did not have a seatbelt. ASME B56.1-1993 requires that use of an operator restraint system be provided and used on a powered industrial truck. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: (a) Ensure that a seatbelt retrofit kit is available through the fork truck manufacturer and is installed on the vehicle. (b) Ensure that employees are utilizing a seat belt as required by ASME B56.1-1993 (c) Replace existing equipment with equipment that is in compliance with this requirement.
