OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck by falling material and collapsing racks. a) Dry Department: On January 31, 2020, and at times prior, the employer exposed employees to struck-by hazards in that the ends of the storages racks UL and UM , located near the maintenance and battery area, had bent and damaged supports. Employees operated powered industrial trucks at and around them.
