29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye: (a) Panera LLC (Café 6072), 4229 N. 5th Street, Temple, Pennsylvania - An employee suffered head, back and, shoulder injuries, resulting in hospitalization, on January 17, 2020 as a result of falling from a step stool. The employer failed to report this work-related hospitalization to OSHA within 24 hours. (The employer reported this hospitalization to OSHA on January 20, 2020.) Panera LLC was previously cited for violations of this Occupational Safety and Health Standard 29 CFR 1904.39(a)(2) which were contained in: OSHA inspection number 1123709, citation number 1, item number 1 and was affirmed as a final order on March 7, 2016, with respect to a workplace located at 181 C. Tom Hills Senior Boulevard, Macon, GA 31210; and OSHA inspection number 1444240, citation number 1, item number 1 and was affirmed as a final order on December 18, 2019, with respect to a workplace located at 1500 Camp Hill Bypass, Camp Hill, PA 17011.
