Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 - Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and caught-in between hazards due to unexpected load failures resulting in crushing bodily injuries to limbs and the torso, and possible death, due to wire rope winches/hoists/lifting mechanisms not designed, engineered and installed to support, without failure, steel vat lips and other objects exposing workers to sudden and unexpected load failures. Facility: On or About January 22, 2020, the 5/32 inch diameter wire rope cable of the Chicago 1500 pound capacity winch/hoist/lifting mechanism secured to a steel I beam above a 1,078 gallon stainless steel wine vat measuring 62 inches in diameter and 80 inches in height and used to vertically lift/hoist the 62 inch diameter, 225 pound vat cover/lid failed/broke resulting in the vat cover/lid unexpectedly falling striking an employee's right arm resulting in bone fractures and severe contusions.
