OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: struck by hazards caused by the movement of the 10" steel pipe. The employer is failing to protect employees from being struck-by falling materials. On November 13, 2019 an employee used an unsecured strap to lift a 10" steel pipe, by hanging the strap from the tooth of the bucket on a Caterpillar 336F front-end loader/excavator. The loader operator attempted laying the 10" steel pipe in a 2' excavation when the load shifted and the strap came loose from the bucket tooth. The steel pipe struck the employees legs. Among other methods, feasible and acceptable means of abatement would be to: 1. Provide training to all operators on the proper use of machine and to follow procedures within the operator's manual. 2. Establish a restricted-access zone for employees working around the equipment. 3. Train employees to be aware of their surrounding when near heavy equipment. 4. Ensure all employees who lift pipe with machines are trained on the proper lifting locations of the Caterpillar 336F. 5. Train all employees tasked with using the Caterpillar 336F on warnings and safety instructions/procedures when using it to lift materials.
