OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees by exposing employees to struck-by hazards. a) Dock stations area/Warehouse - On or about December 3, 2019, the employer exposed employees to the struck-by hazards in that employer failed to ensure that employees were wearing a safety belt while operating LPG Toyota forklifts (Serial # 16543, Serial # 16597 & Model # 8FGCU18), (Serial # 16597 & Model # 8FGCU18) for loading and unloading the pallets contained bags of chemicals.
