OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard while working in the shadow of an unsecured stone slab during a material handling activity. (a) At the outside storage area: On or about 11/22/2019, the employer did not develop and implement an effective handling procedure that addressed adequate bracing and stability of the stone slab, or employee safety, while working in the fall shadow area of the stone slab handling zone.
