OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards associated with the operation of wheel loaders. (a) Ellenboro Shop - On or about 9/20/19, employees were working near and handling a load being lifted by a John Deere Wheel Loader, exposing employees to struck-by hazards. Among other methods, feasible and acceptable means to abate the hazardous condition include: 1) Keeping bystanders clear at all times. Keeping bystanders away from raised booms, attachments, and unsupported loads per the operator's manual. 2) Ensuring that objects being lifted are secure per the operator's manual. 3) Ensuring load is against backrest of forks per the operator's manual.
