29 CFR 1926.20(b)(3): Machinery, tool(s) , material(s) , or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and/or was not either identified as unsafe by tagging, or locking the controls to render them inoperable, or physically removed from its place of operation. (a) At the residential construction site - the employer did not ensure that a Truck Mounted Concrete Pump, Model KYM 34XT Truck# 1 M2K189C6 YM0140, Vehicle# 3404, was identified as unsafe, rendered inoperable and/or taken out of service due to a defective safety interlock device on the hopper gate, thereby exposing employees to amputation hazards when cleaning the concrete hopper, on or about October 22, 2019.
